Terms of Service

By creating an account or using Make Memoir, you agree to be bound by these Terms of Service and our Privacy Policy. You must be at least 18 years old to create an account and purchase a subscription. If you are using Make Memoir on behalf of an organization, you represent that you have authority to bind that organization to these terms.

Make Memoir is a family storytelling service that enables subscribers to capture video recordings of a loved one answering weekly prompted questions. The service includes:

• Weekly email prompts sent to your designated storyteller for up to 52 weeks
• Browser-based video recording (no app download required for the storyteller)
• AI-powered transcription of recordings and generation of written stories
• A family library of stories accessible to invited family members
• One hardcover keepsake book produced at the end of the subscription year, containing all recorded stories and QR codes linking to the original videos

Each subscription covers one storyteller. Additional storytellers may be added as described in your plan details.

You must provide accurate and complete information when creating your account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. The person who purchases the subscription (the “account holder”) manages the account, invites the storyteller, and controls delivery of the book. The storyteller receives prompts and records responses but does not require a paid account.

• Price: $99 per year, billed annually via Stripe.
• Auto-renewal: Your subscription automatically renews each year unless you cancel before the renewal date. You will receive a reminder email at least 14 days before renewal.
• Refunds: We offer a 30-day money-back guarantee if fewer than 4 prompts have been answered and book production has not yet begun. After that, no partial refunds are issued for unused portions of the subscription year.
• Failed payments: If a renewal payment fails, we will notify you and provide a grace period of 7 days to update your payment method before service is suspended.
• Taxes: Prices do not include applicable sales tax or VAT, which may be added depending on your location.

• You may cancel your subscription at any time from your account settings.
• Access to the service and your stories continues until the end of your paid subscription period.
• After cancellation, your recordings, transcripts, and stories are retained for 30 days, during which you may download your data. After 30 days, your content is permanently deleted.
• If a storyteller passes away during an active subscription: Your data is not auto-deleted. Access remains available to the account holder for the full paid period. We encourage you to download your family’s recordings and stories. Please contact us at support@makememoir.com — we are deeply sorry for your loss and will do everything we can to help you preserve your family’s memories.

You agree not to use Make Memoir to:

• Upload content that is illegal, harmful, defamatory, or harassing
• Record or upload content of another person without their knowledge and consent
• Impersonate any person or entity
• Attempt to access another user’s account or data
• Use the service for any commercial purpose other than as expressly permitted
• Attempt to reverse-engineer, scrape, or otherwise extract data or code from the platform

We reserve the right to suspend or terminate accounts that violate these rules.

You and your family retain full ownership of all recordings, transcripts, and stories created through Make Memoir. By using the service, you grant Make Memoir a limited, non-exclusive license to store, process, and transmit your content solely for the purpose of delivering the service (including producing the hardcover book). This license terminates when you delete your content or your account is closed.

We do not claim any ownership interest in your family’s stories. We will never sell, license, or publish your content to third parties without your explicit consent.

Make Memoir uses AI to transcribe video recordings and generate written stories. By using the service, you consent to this processing. The AI-generated text is editable by the account holder and is provided as a starting point, not a verbatim transcript. Make Memoir does not use your recordings, transcripts, or stories to train AI models — ours or any third party’s.

• Book production begins approximately 8 weeks before your subscription anniversary.
• You will receive a digital preview for approval before printing. Once approved, the book cannot be modified.
• One hardcover book is included with each annual subscription. Additional copies are available to order at cost (printing and shipping).
• Printed books are shipped to the address on file. Estimated delivery is 4–6 weeks after approval.
• Make Memoir is not responsible for delays caused by shipping carriers or incorrect addresses provided by the account holder.

The Make Memoir platform, website design, software, brand, and documentation are owned by Make Memoir, Inc. and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our platform without our written permission.

The service is provided “as is” without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that AI-generated transcriptions and stories will be perfectly accurate. AI-generated text may contain errors and should be reviewed before including in the final book.

To the maximum extent permitted by law, Make Memoir’s liability to you for any claim arising out of or related to these terms or the service is limited to the amounts you paid to us in the 12 months preceding the claim. Make Memoir is not liable for indirect, incidental, special, consequential, or punitive damages.

These terms are governed by the laws of the State of Nebraska, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of Make Memoir will be resolved in the state or federal courts located in Lancaster County, Nebraska. You waive any objection to jurisdiction or venue in those courts.

You and Make Memoir agree to resolve disputes only on an individual basis. You waive any right to bring or participate in a class action or representative proceeding.

We may update these Terms of Service from time to time. For material changes, we will notify you by email at least 30 days before the change takes effect. Your continued use of Make Memoir after the effective date constitutes acceptance of the revised terms.
